Shout Out On Line Email Contest Guidelines Franklin Youth Initiative Shout Out On Line Email Contest Guidelines Binding Agreement: In order to enter the Contest, you must agree to the Official Rules of the Franklin Youth Initiative(FYI) Shout Out On Line Email Contest. Therefore, please read these Rules prior to entry to ensure you understand and agree. You agree that submission of an entry in the Contest constitutes agreement to these Rules. These Official Rules form a binding legal agreement between you and FYI with respect to the contest. Eligibility: The Contest is open to individuals who are residents of Franklin Township 13-18 years of age enrolled in 7th to 12th grades. A person is ineligible to enter and/or win a contest if: they are a Full-time employee or a member of the immediate family of a full-time employee. They have won a prize in an FYI contest in the 60 days prior to entering that contest. They are discovered to have used, or attempted to use more than one name in order to qualify to win prizes from FYI. How to Enter: The Contest begins at 12:01 a.m. on the 1st on the month. Winners will be chosen from all supplied and valid corresponding emails received. Entrants must send entries using the correct contest entry email address via the FYI website SHOUT OUT Contest, subject line, and/or any other specific entry information requested in the contest announcement. FYI accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, deletion, tampering, theft, destruction, transmission interruption, communications failure or otherwise. FYI has no control over communications networks or services and accepts no responsibility for any problems or issues arising from them. FYI is not liable for any consequences of user or network error including costs incurred. Winners of all contests will be contacted at the”entrant” email address used to enter the contest, and the person receiving and replying to the winner announcement email will be considered the winner unless otherwise allowed by a specific contest rule amendment. Only one entry per email address used to send the email will be considered for contest entry in a contest period, unless multiple entries are specifically allowed in the contest posting. Unless otherwise specified in an individual contest post, no person may enter any contest more than once using multiple email addresses. Each entry must be the entrants’ original work and the entrant must undertake to FYI that their entry is original, and by its use, FYI will not be in breach of any third party intellectual property rights. Entries that are deemed inappropriate (i.e. bad taste), offensive, defamatory or otherwise objectionable, or in breach of third party intellectual property rights will be deemed invalid. Conduct: By entering the Contest, you agree to comply with and be bound by these Official Rules. Failure to comply with these rules may result in disqualification from the contest. You further agree to comply with and be bound by the decisions of the judges, which are final and binding in all respects. Franklin Youth Initiative reserves the right in its sole discretion to disqualify any entrant it finds to be; (1). Tampering or attempting to temper with the entry process or the operation of the contest; (2). Violating the Official Rules; (3). Violating the terms of service, conditions of use or general rules or guidelines; (4). Acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person. Any false information provided within the context of the contest by an entrant concerning identity, postal address, ownership or right or non-compliance with the rules may result in the immediate elimination of an entrant from the contest. FYI further reserves the right to disqualify an entry that it believes in its sole and unfettered discretion infringes upon any law or otherwise does not comply with these rules. Caution: any attempt by an entrant or any other individual to deliberately damage any property or undermine the legitimate operation of the contest may be a violation of criminal and civil laws. Should such an attempt be made FYI reserves the right to seek damages from any such person to the fullest extent permitted Notification of Winners: The competition will be drawn and/or decided at the time, on the date/s and at the location/s as specified by FYI. Winners will be notified by email on or about the 30th of the contest month. To claim a prize, a winner must comply with the following requirements within (15) days of notification sent from FYI of their award: 1. Reply to the email notification of award sent by FYI to the “entrant” email address within (15) days of notification. 2. Prize winners in each category will be required to sign and return, within (15) days of notification an affidavit of Eligibility/Compliance, a Hold Harmless and Liability Release and a Publicity Release, as allowed by law, and may be required to sign and return a statement affirming his/her Representations, Warranties, and Grants of Rights as stated above and any other documents as may be reasonably requested by Sponsor. Failure to return any documents within the time specified or failure to respond to notification attempts or return of any prize notification as undeliverable will result in disqualification and determination of an alternate potential winner. Winners under the age of 18 require the signature of Parent or adult guardians on all forms. 3. If the prize is not picked up within 15 days of the date of the sent email notification, the prize may be forfeited and the next highest scoring entry may be selected as the alternate winner. Failure to respond shall mean that the winner forfeits the prize. FYI is not required to award elsewhere any prizes forfeited by the chosen winner(s). Contest entries and material submitted in association with any contest (whether in written, print, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of competitors become the property of FYI which may use the material in any medium (including, but not limited to; the internet) and in an reasonable manner it sees fit. Copyright in any such material becomes and remains the sole property of FYI. No Return: Entries will not be acknowledged or returned. No telephone calls will be accepted. Contest sponsor is not responsible for misdirected entries or technical malfunctions and may suspend, modify or terminate the contest in the event of early termination, judging and selection of winners will take place using all eligible entries received prior to termination. Entries will not be returned to entrants. Taxes: Liability for applicable taxes and any other expenses not expressly included in the prize will be the liability of the winners. Any required tax reporting forms will be furnished to the IRS. By entering this contest and/or by accepting a prize, you agree to accept these contest rules which are final. Comply with Laws: This contest is subject to federal, state and local laws. You agree to be bound by these rules and you give your express permission to be contacted by sponsor mail. Publicity/Media Activity: By participating in this contest, you agree and hereby grant FYI permission to use, copy, modify and make available your submission to the public (with or without attribution to you) for any purpose, such as, but not limited to, press and media communications, without further compensation to you. You also agree to participate in any media or promotional activity regarding the contest. If you are a winner, you agree that FYI may use your name and likeness to administer and promote the contest and to conduct media interviews and promotional events. Privacy Notice: By participating in this contest, you agree that we can collect your personal information, and that if we cannot collect the required data, you may not be eligible to participate in the contest. Any personal information collected during the course of the competition by FYI will only be used for administering this contest and for other purposes as outlined in these rules, and will be subject to the practices described in the FYI privacy policy. You will have the right to access, review, rectify or cancel any personal data held by FYI by writing www.franklinfyi.org. Sponsor Entry Use: Each participant grants to sponsor, its successors, licensees and assigns the irrevocable, non-exclusive right to use the entry submission in connection with the contest and any advertising, publicity, and promotion, any manner at any time or place, in any present or future media, in perpetuity. Sponsor shall have the right, it its sole discretion, to edit, composite, morph, scan, duplicate or alter the entry submission for any purpose which sponsor deems necessary or desirable. Hold Harmless: You hereby agree to hold FYI and its affiliates, subsidiaries, licensees, sponsors and assigns harmless from and against, and hereby waive any right to pursue, any claims of any nature arising in connection with the inclusion in, publication via or display on any FYI site, or any other use authorized under these Terms, of any photo or information submitted to FYI by you; Judging: Judging and Selection of Winners: Entries will be judged by one or more representatives of FYI based on the judging criteria listed below and in the event that no winning entries are received, no prize will be awarded. Decisions of the judges are final and binding. The winners will be announced on or about the 30th of the contest month and will be notified by email. Judging Criteria: 25% Relevance, 25% Clarity of expression, 25% presentation, 25% creativity/originality and one prize will be awarded per category. In the event of a tie, the tied entries will be reviewed by an additional judge who will serve as a tiebreaker and who will evaluate entries according to the Judging Criteria listed above. As a condition of winning, prize winners in each grade category will be required to sign and return, required to sign and return, within (15) days of notification an affidavit of Eligibility/Compliance, a Hold Harmless and Liability Release and a Publicity Release, as allowed by law, and may be required to sign and return a statement affirming his/her Representations, Warranties, and Grants of Rights as stated above and any other documents as may be reasonably requested by Sponsor. Failure to return any documents within the time specified or failure to respond to notification attempts or return of any prize notification as undeliverable will result in disqualification and determination of an alternate potential winner. Prizes: Prizes will be awarded for each category. The Sponsor, reserves the right to substitute any or all prize components with another prize of equal or greater value. All taxes, fees, and any applicable withholding and reporting requirements are the sole responsibility of the winners. Any unclaimed prizes will not be awarded. Limit one (1) prize per person per contest period. The prizes will be awarded provided there are a sufficient number of eligible entries received. Prizes may not be transferred or substituted, except by Sponsor with one of equal or greater value Prize winners are solely responsible for all taxes and/or fees that may be incurred. Winner may forfeit any and all winnings if verification cannot or has not been made within 15 days. All prize winners are required to verify proper and legal picture identification and to claim prizes with 15 days of notification of winning the prize. Each prize winner must supply FYI with his/her legal name, mailing address, birth date, day and evening telephone numbers, to verify eligibility. Winner may not request substitutions of prize winnings. All winners are solely responsible for any and all taxes and/or fees, and all such additional costs that may be incurred. FYI reserves the right to alter any rules of any contest at anytime. If you have any questions or complaints about an FYI contest, please contact them directly. It is the sole responsibility of winners to collect their prizes and all prizes must be collected within 15 days from the date of winning. After that time, unclaimed prizes will be dealt with according to legislative requirements. FYI will not notify winners of time remaining. In special situations, and subject to the absolute discretion of FYI, a winner may nominate a designated guardian to collect a prize. The representative will be required to present written authorization from the winner and identification which includes a photograph for both the winner and their representative. Prizes are non-transferable, must (where applicable) be used on the dates specified and are not redeemable for cash. Fyi is not responsible for claims for unused, expired or lost prizes. All prizes are accepted entirely at the risk of the winner and FYI excludes all warranties in connection with any prize to the extent permitted by law. FYI, its agencies, affiliates, sponsors and representatives are not responsible for defective prizes or misuse of any prize, or for any claims, liability, loss or damage arising out of or in connection with any contest promoted by FYI. If a specified prize becomes, unavailable, FYI may substitute a replacement prize at is absolute discretion. When a prize involves the winner attending an event, or meeting and/or attending a function with a celebrity or other public figure (or where the celebrity or public figure is going to be present), FYI will not be liable if any part of the event is abandoned, varied or delayed for any reason, or for the failure of the winner to meet that person or failure of that person to attend the function for whatever reason. FYI will not provide a substitute prize or cash in lieu of this occurrence. If the prize is a voucher, all vouchers are valid until the expiration date as noted on the voucher. Redemption of the voucher is subject to the terms of service of the voucher provider and may not be varied. Vouchers cannot be redeemed for cash or for other vouchers. If the prize includes tickets, all tickets are valid for the date or period as indicated on the tickets, and are subject to the terms of service of the ticket provider. FYI will not replace lost tickets. FYI may in its absolute discretion declare an entrant invalid or prevent an entrant’s participation in promotional activity, cancel a prize or otherwise desist from providing benefit to a winner and companion/s if the winner, in the opinion of FYI staff, is under the influence of alcohol or drugs, behaves aggressively or offensively or behaves in an anti-social manner in a way that may diminish the good name of FYI and all associated sponsors, or if their behavior is against the law, or considered to be otherwise inappropriate. If due to any reason whatsoever, FYI becomes aware after an entrant has won a prize that the entrant has not complied with these terms (or special Terms and Conditions), that entrant will have no entitlement to the prize, even if FYI has announced them as a winner and that entrant will be required, at the direction of FYI to return, refund or otherwise make restitution of the prize.
